1. Acceptance of Terms

Owl Alliance LLC is not a licensed real estate brokerage, unless explicitly stated otherwise in writing. We do not represent buyers or sellers in a fiduciary capacity.

5.2 No Agency Relationship

Use of the Service does not create a broker-client, agent-client, attorney-client, or fiduciary relationship between you and the Company.

5.3 No Legal, Financial, or Tax Advice

All information provided through the Service is for general informational purposes only and does not constitute legal, financial, tax, or investment advice. You are encouraged to consult with licensed professionals before making any real estate or financial decisions.

6. Property Information Disclaimer

Any property information, estimates, valuations, timelines, or potential outcomes provided by the Company are not guarantees and may vary based on market conditions, title status, inspections, and other factors outside the Company’s control.

7. User Conduct

You agree not to:

  • Use the Service for unlawful purposes

To the fullest extent permitted by law, Owl Alliance LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or loss of use, arising out of or related to:

  • Your use of or inability to use the Service

  • Any property transaction, communication, or agreement involving the Company

  • Any third-party services or websites

Even if the Company has been advised of the possibility of such damages.

If liability is found, the Company’s total liability shall not exceed the amount paid by you, if any, to the Company in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Owl Alliance LLC, its owners, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses arising out of or related to:

  • Your violation of these Terms

  • Your violation of any law or third-party rights

13. Arbitration & Dispute Resolution

13.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

13.2 Location

Arbitration shall take place in Taney County, Missouri, unless otherwise agreed by both parties.

13.3 Waiver of Jury Trial & Class Actions

You and the Company agree that all disputes shall be resolved on an individual basis only and waive any right to a jury trial or participation in a class or representative action.

13.4 Opt-Out Right

You may opt out of arbitration by sending written notice within thirty (30) days of first using the Service to:

Your notice must include your full name and a clear statement of your intent to opt out of arbitration.

14. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.

If arbitration is not applicable or is opted out of, any legal action shall be brought exclusively in the state or federal courts located in Taney County, Missouri, and you consent to personal jurisdiction and venue in those courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding use of the Service and supersede any prior agreements or understandings.
